Acceptance of terms

By using Memsmo™ (“the Service”), you agree to these Terms of Service. If you do not agree, please do not use the Service. These terms are between you and QForma LLC, owner of the Memsmo™ brand and service.

Description of the service

Memsmo lets you create private memory collections, invite contributors, and transform those memories into interactive experiences and physical keepsakes. Some features are free; others, such as printed keepsakes, require payment.

Accounts and eligibility

You must be at least 13 years old to use Memsmo. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

Your content

You retain ownership of the photos, stories, quotes, and other content you upload to Memsmo. By uploading content, you grant us the limited right to use, store, display, and process it solely to operate and improve the Service — including generating games, previews, and printed products.

You are responsible for ensuring that you have the right to share any content you upload and that it does not violate the rights of others.

Prohibited use

You may not use Memsmo to:

• Upload content that is illegal, harmful, threatening, defamatory, or infringing.
• Harass, abuse, or impersonate others.
• Attempt to access accounts or data that do not belong to you.
• Reverse-engineer, scrape, or interfere with the Service.
• Use the Service for any commercial purpose not expressly permitted.

Keepsake purchases

When you order a physical keepsake, you authorize us to charge the listed price plus applicable taxes and shipping. Production and fulfillment are handled by our print partner. Estimated delivery times are provided for convenience and are not guaranteed.

You are responsible for reviewing your design, text, and shipping address before placing an order. See our Refund Policy for information on returns and reprints.

Termination

We may suspend or terminate your access if you violate these terms or misuse the Service. You may delete your account at any time. Upon termination, your right to use the Service ends, but provisions related to content ownership, liability, and dispute resolution survive.

Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. To the fullest extent permitted by law, QForma LLC disclaims all warranties, express or implied.

Limitation of liability

To the fullest extent permitted by law, QForma LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service.

Governing law

These terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Missouri.

Changes to these terms

We may update these Terms of Service from time to time. We will update the “Last updated” date when we do. Continued use of the Service after changes means you accept the updated terms.
